The lawsuit has to do with Musk's now-infamous tweet in which he was "considering taking Tesla private at $420. Funding secured." It's those last two words that have caused a problem with the SEC. "In truth and in fact, Musk had not even discussed, much less confirmed, key deal terms, including price, with any potential funding source," says the SEC suit.
